  1. General conditions

The General Terms and Conditions (hereinafter: the Terms and Conditions) have been prepared in accordance with the applicable legislation of the Republic of Croatia and apply to customers who have their domicile or residence in the territory of the Republic of Croatia. The Terms and Conditions specify the rights and obligations of visitors, users and customers as well as business between the trader AQUA SUB d.o.o. (hereinafter: AQUA SUB) and the user and customer (hereinafter: the Customer) of products offered in the webshop (hereinafter: the Shop).

Our website is and is edited by AQUA SUB.

By using the website (hereinafter: the website) to purchase or collect information about AQUA SUB products, you acknowledge that you are familiar with these Terms and Conditions and agree to their application. If you do not agree to these Terms and Conditions, do not use the website to purchase or obtain product information.

By accessing and using the website, each user agrees to abide by these Terms and Conditions and agrees to be subject to the regulations of these Terms and Conditions.

Under no circumstances shall AQUA SUB be deemed to assume any responsibility arising from the use of this website, for any actions on the part of the user using or misusing the content of this website, and for any damage which the user or third parties may incur as a result of such use, or misuse of the content of this website.

  1. The Customer

The Customer is a physical or legal entity concluding a purchase on this website. The Customer is required to enter the correct data when registering and ordering. The Customer must have legal capacity.

  1. Accessibility of information

Trader agrees to provide the Customer with the following information at all times:

  • Company identity – name and place of business and registration number,
  • Contact information for quick and efficient communication (email, telephone),
  • Basic characteristics of the product or service being offered,
  • Availability – all products or services offered in the AQUA SUB Shop should be available within a reasonable period,
  • Terms of product delivery or performance – mode of operation, place and time of delivery,
  • All prices should be defined clearly and unambiguously and additional costs should be indicated – should they include taxes and transportation costs, method of payment and delivery, period of validity of the offer,
  • The deadline for withdrawing from the contract and the conditions for withdrawal should the Customer decide to return the product,
  • Clarification of the complaint procedure, including contact information with customer service.
  1. Product sale

The price is clearly specified and is the retail price, expressed in EUR, including VAT.

The minimum order value of individual orders is not specified.

Discounts are clearly indicated and include the price before the discount and the price during the discount. You can use the coupon to save on your purchase or get other benefits if you have a security code. Coupon code can be earned as a reward for a previous purchase and as a promotional code.

While we try to show what our products look like realistically through product photos, they may not necessarily be true to the actual product. Our products are handmade and there will always be some differences.

As a result of a large number of orders, if the product’s availability in the storage is not well documented, there is a possibility that it will not be available after the order has been processed. If this occurs, we will inform the Customer of the issue and the period within which the product will be available, as well as offer the Customer the option of cancelling the purchase, waiting until the product is available, or replacing it with an available product.

Given that the Shop is online, the Shop’s product range is updated and changed frequently and rapidly. This can lead to unintentional errors. Should they occur, please let us know by sending an email to, and we will try to resolve them as soon as possible.

  1. Prices

Online prices are valid for all Shop members. To become a member, please register. All prices include VAT, unless stated otherwise. Shipping costs are not included in the price. Prices are valid only for orders placed electronically in the Shop. The prices are valid at the time of completion of the order form and have a predetermined value. Prices are valid for payments made through the payment methods specified in Art. 6 of these Terms and Conditions.

  1. Payment methods

The Customer selects the available products, stored in the shopping cart. The current order value is always clearly displayed, and the Customer can add and remove individual items and their quantity at any time. After selecting a product, the Customer proceeds to checkout.

The Customer can choose from several payment methods:

  • GENERAL PAYMENT SLIP / ELECTRONIC BANK TRANSFER – the payment is processed manually once it is evident on the transaction account of AQUA SUB, and at least once a day each weekday. The Customer is required to provide the order number so that the payment can be properly processed.
  • CASH ON DELIVERY – the payment is processed manually and at least once a day each weekday.

Note: For cash on delivery transactions, Hrvatska pošta charges a fee for money transfer in accordance with the current price list available on their website. Payment by cash on delivery is available only for customers with address in Croatia.


We accept the following cards through the MyPOS service: Visa, Mastercard, Maestro, American Express, Union Pay, JCB, Bancontact. If you are paying with a card, select the type of the card you are paying with on the secured website Payments by cards via the MyPOS Payment service are processed immediately.

  • Via PayPal

What is PayPal? PayPal provides online payment and money transfer services. To use PayPal, you should register at Payments by PayPal are processed immediately.

The customer can view payment receipts in the details of their user account and via email notification.

AQUA SUB is obligated to issue an invoice to the Customer. The order is stored electronically on the server of the service provider.

All payments are in Euro (EUR). If you are paying in a different currency, please note that the bank may charge you a separate currency conversion fee or the amount of debit note may be slightly higher due to exchange receivables. Payment is processed in EUR at the point of order.

  1. Registration

In order to use the AQUA SUB Shop, you may have to complete the registration process.

By registering, the Customer will be able to save the orders they have placed and subsequently check the orders they have already received.

  1. Order and purchase


Upon order placement, the Customer will receive an email notification from AQUA SUB that the order has been received. The Customer has the right to cancel the order without any consequences within one hour after receiving the email. In addition to cancelling the order, the Customer may also change the contents of the order (quantity or type of product). The Customer can access information about the status and quantity of the order.

Order confirmation

If the Customer does not cancel or change the order, it will be processed further. Upon order placement, AQUA SUB will review the order, check the availability of the ordered products, and confirm or reject the order if there are any problems with product availability. AQUA SUB may contact the Customer by phone to review the data or the accuracy of the order. After order confirmation, AQUA SUB will inform the Customer about the expected time of delivery.

The contract governing the purchase of ordered products between AQUA SUB and the Customer is effective from the moment of the order confirmation (the Customer receives an e-mail about the status of the confirmed order). From that moment on, all prices become fixed and apply to both AQUA SUB and the Consumer.

Purchasing contract

AQUA SUB will issue a written invoice to the Customer who purchases products in the Shop, with the costs clearly displayed. The purchasing contract is stored in an electronic form on the AQUA SUB computer and is accessible to the Customer at all times in his user account. The purchasing contract is written in Croatian.

  1. Shipping

AQUA SUB ships via GLS, DPD and HPekspres delivery services. Delivery is made across the entire territory of the Republic of Croatia. For the first zone (larger cities and towns) the delivery time is 24 hours and for the second zone (smaller towns and islands) the delivery time is 48 hours.

AQUA SUB delivers orders within 3 working days after payment or after the order itself in case of paying via cash on delivery.

Shipping is charged 4,50 EUR, including VAT. Shipping is free for orders over 30,00 EUR.

Should the order be returned after it has been sent, the Customer is required to pay the postage for the return shipment, regardless of whether the Customer was previously granted free shipping as a result of the order amount.

All deliveries outside the Republic of Croatia are charged according to zones as follows:

 Zone 1 includes the countries: Slovenia, Poland and the Czech Republic. Delivery is charged 8.00 EUR including VAT. There is no delivery charge for orders over 60.00 EUR.

 Zone 2 includes the countries: Austria, Belgium, Bulgaria, Denmark, Estonia, Germany, Hungary, Latvia, Lithuania, Luxemburg, the Netherlands, Romania and Slovakia. Delivery is charged at EUR 10.00 including VAT. There is no delivery charge for orders over 70.00 EUR.

Zone 3 includes the countries: France, Italy, Portugal and Spain. Delivery is charged EUR 15.00 including VAT. There is no delivery charge for orders over 75.00 EUR.

Zone 4 includes the countries: Bosnia and Herzegovina, Finland, Greece, Ireland, Montenegro, North Macedonia, Serbia, Sweden, Switzerland, Turkey and the United Kingdom. Delivery is charged EUR 20.00 including VAT.

There is no delivery charge for orders over 90.00 EUR.

For all other countries, which are not included in the above mentioned zones, delivery is charged 30.00 euros.

AQUA SUB delivers orders within 3 working days after payment or the order itself in the case of cash on delivery.

If the order is returned after sending, the customer is obliged to pay the amount of the postage for resending, even if he was previously entitled to free postage due to the size of the order.

  1. Cancelling the order and product return

AQUA SUB promises to ensure that the products shipped are properly and securely packaged to prevent damage to the shipment. Should you notice any damage to the package, you are not obligated to collect the package.

The Customer has the right to submit a statement/notice of cancellation of purchase at or by post within 7 days of receipt of the ordered products, without having to specify the reason for the cancellation. To return purchased products before the expiry of contract withdrawal period, a notice of cancellation is sufficient. In accordance with the Consumer Protection Act, the Customer may unilaterally terminate the contract within 14 days without stating any reasons.

The Customer, in order to exercise the right to unilaterally terminate the contract, must notify AQUA SUB of its decision to unilaterally terminate the contract before the expiration of the period by sending a unambiguous statement by post or email at, surname, address, telephone number or email address.

The period for unilateral termination is 14 days starting from the date of delivery of the goods to the Customer or a third party appointed by you, that is not the carrier.

Should the Customer unilaterally terminate this Contract, we will refund the money received from the Customer, including delivery costs, without undue delay and no later than 14 days after receipt of the Customer’s unilateral decision to terminate the Contract.

Any refunds issued for returned products will be made using the same payment method used by the Customer. Should the Customer agree to the refund payment by other means, the Customer shall not bear any costs related to the refund.

Only after the goods have been returned to AQUA SUB or after the Consumer has provided us with proof that the goods have been sent back to us, we can refund the money.

The purchased products must be returned unused and intact, in the original packaging and in the same amount, unless the products have been destroyed, left unpackaged or their quantity has decreased through no fault of the Customer. If the parcel containing goods arrived to the Customer in a damaged condition, without contents, with the parcel opened, the Customer should initiate a complaint to the carrier.

  1. Security

AQUA SUB uses technical and organizational means to ensure the protection of processed and stored personal data and payment details. To this end, we use a 128-bit SSL certificate issued by an authorized organization. The Customer is also responsible for the security by ensuring that their username and password are secure and that their computer is protected against malware and viruses.

AQUA SUB does not maintain any record of your card number or store any transaction data, but uses the services of a third party which is an authorized financial institution that will protect your data through encryption.

AQUA SUB will not accept orders from anyone suspected of being a child unless they have written permission from a parent or guardian. AQUA SUB online shop does not provide access to products that may be harmful to children. AQUA SUB will not collect personal data from children or third parties without the written permission of a parent or guardian, unless obtained from a parent or guardian. All communication with children will be age appropriate and will not exploit children’s lack of experience and loyalty.

  1. Responsibility

AQUA SUB tries to ensure that the information published on our website is up to date and correct. Nevertheless, product features, delivery times or prices can change so rapidly that the retailer may not correct the information on the website in time. If this occurs, the Customer will be informed of the changes and will be given the opportunity to withdraw from the contract or to replace the ordered product. Even though AQUA SUB aims to provide accurate images of items for sale, all photographs included are symbolic. Photos do not guarantee the properties of the products. AQUA SUB is not responsible for any damage, destruction, loss, lack of content in the shipment and opening of the shipment from the moment of shipping the ordered products. In the aforementioned examples, the Customer must contact the delivery service and initiate the complaint process. Together with the delivery service, AQUA SUB will do everything in its power to resolve the complaint as quickly as possible.

  1. User opinions

Opinions, comments and product reviews provided by the Customers or website visitors are part of the Shop’s functionality and intended for the user community. AQUA SUB is not responsible for any opinion, comments, or product reviews provided by Customers or visitors, and disclaims any responsibility arising from such information. AQUA SUB reviews and discards all opinions, comments and ratings that are blatantly false, offensive, misleading, obscene or of no use to other visitors and users according to AQUA SUB. By posting opinions, comments, or ratings, the Customer or visitor permits AQUA SUB to use or publish the content, whether in full or in part, by any electronic or other means, and without time or other limitation, provided that doing so is in AQUA SUB’s business interest. This includes posting in ads or other types of communication. Any author of opinions, comments or ratings guarantees that they are the owner of material and ethical copyrights for the opinions, comments and ratings they have written and that they will provide them to AQUA SUB free of charge and for an unlimited period of time.

  1. Protection of personal data on the website

AQUA SUB understands that many Customers and other users of our website may be concerned about the information they have provided online and may question how it is stored and used. AQUA SUB fully respects the privacy and protects the personal data of its users, employees, business partners or others it conducts business with and whose personal data it collects and processes as part of its day-to-day operations. We only collect personal data that has been voluntarily provided to us and for which we have obtained permission to use. In fact, we do not request this information from you in order to grant you access to our website, and we do not request that you disclose more information than is truly necessary to participate in activities on our website.

We primarily collect personal data in accordance with the applicable legislation and in compliance with the General Data Protection Regulation (GDPR), which entered into force on May 25, 2018. We do this so we can email you any updates and news, give you a chance to participate in our contests and to notify the winner, send out publications, brochures and other promotional materials, and answer any questions or advice you may have. AQUA SUB does not collect data of minors. Please do not provide any personal data, including your first and last name, home address, telephone number or email address, if you are a minor. Personal data should not be submitted by minors without the permission of a parent or guardian. In case of contact upon request of a minor, AQUA SUB explicitly disclaims any responsibility for material or immaterial damages resulting from the use of personal data collected from a minor. It is possible to obtain an overview of all personal data we have obtained from you at any time. Upon your request, we may update, correct, transfer or delete any previously provided data (if such data is still in our databases) or cease to use such data in the future.   1. Confidentiality of data

AQUA SUB agrees not to disclose, publish or make available to third parties any personal data relating to the Customer without their prior consent to such disclosure. Please be aware that your personal data will remain confidential upon visiting this website, unless you choose to disclose it voluntarily. The information obtained will not be disclosed to any other party except for the purpose of legal investigation. Data that is automatically collected upon accessing the website that is not personal data (including, yet not limited to, search engine types, number of visits, time spent on the website, etc.), AQUA SUB has the right to use it for statistical purposes in order to estimate website traffic and improve its content and user-friendliness.

  1. Sending emails

When you provide AQUA SUB with any personal information, either via email containing a question or comment, or through the contact form you send us via email, we use that information to respond to your requests. Should AQUA SUB be unable to answer your questions sent by email, you will be required to give your prior consent to forward your email to other employees or suppliers who can answer your questions more effectively.   1. Complaint and disputes

AQUA SUB fully complies with the existing Consumer Protection Acts. At AQUA SUB, we have an effective system for resolving complaints and disputes and a dedicated person responsible for contacting customers via email or phone. Customer can contact us at
We will respond to the Customer’s complaint in writing no later than 15 days after receipt of the complaint, in accordance with the law. AQUA SUB is aware of the fundamentals of costumer disputes, lawsuits and the asymmetry between the economic value and the costs incurred in resolving the dispute. In fact, that is one of the main obstacles for the Customer to avoid initiating any court proceedings. Therefore, AQUA SUB shall seek the best way to peacefully resolve any dispute.
Any disputes that may arise are subject to the jurisdiction of the Commercial Court in Zadar – Permanent attendance in Šibenik. All obligations and rights outside these Terms and Conditions are regulated by the Civil Obligations Act, the Electronic Commerce Act and the Consumer Protection Act.

  1. Amendments to the General Terms and Conditions

In case of any amendment to the Terms and Conditions of the Shop, data security and other areas related to the business of the Shop and in case of any change in the business policy, AQUA SUB will make amendments or updates of the Terms and Conditions and inform the users and visitors of All amendments shall take effect upon the expiry of an eight-day period from the date of publication of the amendments or updates. Where amendments are necessary due to compliance with regulations and laws, it may take effect within a period shorter than specified.
A customer who disagrees with the amendments or updates can cancel his/her registration within 8 days, as this is no longer possible after 8 days. Registration can be cancelled simply by sending a written notice of cancellation to AQUA SUB.
